Very interesting to read the amendment to Federal Rule of Evidence 702, effective December 1, 2023. "The amendment is a direct response to judicial tendencies observed over recent years, where some courts have been too lenient in their gatekeeping role, allowing questionable expert testimonies...Courts will likely witness an increase in pretrial challenges to expert testimony, necessitating judges to engage more deeply with the methodologies and principles underlying such evidence." https://lnkd.in/gX8Ssj-3

No need to bother scratching below the surface of High Court of Justice decisions; the Justices themselves put it all on the table, inviting us to consider where the boundaries of the Court’s power do or don’t exist and how judicial review has been expanded to include every aspect of public life and legislation. What’s a democratic society to do? Who’s in charge here? My recent thoughts on these questions, here: https://lnkd.in/dKXnPSZg

We cannot stress enough the importance of independence in the judicial system. It is the cornerstone of fairness and an effective administration of justice. Let's take a moment to reflect on the impact of government interference in the US legal system, where the consequences of such actions are all too real for lawyers and the courts. Let's strive to maintain and protect the independence of our judiciary, so that justice can be served impartially and without bias.

This is probably one of the most important judgements in 2024 (in a UK context, possibly this century). You will not hear much about it in the majority of the media however. For anyone of an objective, fair minded and democratic disposition ask yourself 2 questions 1) How could this case have been brought in the first place and who is really behind this? 2) Why will only a few media outlets cover this?
Trudi Warner won’t face trial! The High Court slapped down the solicitor general’s “fanciful” attempt to prosecute her for contempt of court, declaring that the minister had “significantly mischaracterise[d] the evidence”.
