According to this recent article by Law.com and Habiba Cullen-Jafar a report by Law Students for Climate Accountability found that between 2019 and 2023, the top 100 firms in the world facilitated $2.89 trillion in fossil fuel transactions, engaged in 518 instances of climate-exacerbating representation, and received $32.97 million in compensation for lobbying on behalf of fossil fuel interests. Next year marks a key opportunity among 27 EU Members States to design their roadmap to 2030 – a crucial moment for climate action in Europe. Key legal issues could include: · Have adequate/legally compliant consultations been undertaken? · Do emissions reduction efforts comply with EU law? · Do the policies meet the target? i.e. do the numbers add up? · Are the targets ambitious enough to meet the goals of the Paris Agreement? CLN is pleased to share a guide to the legal intervention options that could be used to address shortcomings and failures in EU Member State’s National Energy and Climate Plans (NECPs). The report provides information on the legal intervention options that could be used to target shortcomings and failures in the NECPs. It also provides an overview of the key issues and themes that could be subject to challenge (including public consultation, content, ambition of targets, and implementation), and identifies guidance on practical next steps, including the timelines for engagement in the NECP revision process and developing a potential legal intervention. The 2020 – 2030 NECPs are the main policy documents in which EU Member States must articulate how they will contribute to achieving the EU’s overall target of achieving a net 55% reduction in greenhouse gas emissions by 2030. The NECPs are currently being revised, with a view to Member States updating their policies to reflect the EU’s adoption of its Fit for 55 package and target to achieve net zero by 2050. The ongoing NECP revision process will be the last time that EU Member States will be obliged under EU law to formally review and revise their NECPs for the 2020-2030 period. Draft updated National Energy and Climate Plans (NECPs) were due 30th June last. Ireland unfortunately did not meet the EU Commission's filing deadline, and its draft updated NECP is currently still missing. The absence of this key climate planning tool impacts on Ireland's ability to meet its climate targets effectively. Crucially it also means the public haven't had a chance to have a say on what are possibly the most important decisions of our generation. The missed deadline represents a missed opportunity for transparency, establishing consensus and building public trust in climate measure. This feeds into climate denial conspiracy theories about power and control. It also shoots climate action in the foot. Without widespread public support and buy-in for the large scale social transitions required to meet our Paris Agreement commitments, implementation of any measures will likely be ineffective.

The worst law firm offenders for working in fossil fuels reads a bit like a ranking of the largest law firms in the world. The top firms facilitated $2.89 trillion in fossil fuel transactions in the last five years, as well as taking on climate-exacerbating disputes and lobbying, according to a report by Law Students for Climate Accountability Here, we name those firms listed. Important to note that the report is not criticizing all firms for simply advising their clients in this area, it ranks those that are the most heavily involved.
