Thanks Sam!! I’ve been following this very closely to and from the view of someone who builds SaaS products and works with a lot of organisations who also build products and I feel that the Australian government's response to the privacy act review proposes significant changes that could have broad impact on the tech sector and tech startups specifically. While the full impact will depend on additional consultation, (which I will be watching closely,) here are some potential implications to watch: - Removal of the small business exemption may mean privacy obligations kick in once startups hit $3M revenue. - Expanded definitions of personal data would require revisiting data practices and consent flows. This has a particular impact in user onboarding flows that need to be assessed. - New individual rights like erasure and correction would need new processes and tools like we have for GDPR requirements, which for anyone that already includes this it isn’t trivial. - Mandated privacy impact assessments for high-risk activities would require dedicated compliance capacity that needs resourcing. - Tighter overseas data transfer rules could disrupt global data flows and require re-architecture of some global products. - Increased risks of litigation with direct private right of action. While stronger privacy is welcome, the uncertainty and added compliance burden could stifle emerging startups. We in the tech sector will need to engage in the next round of consultation to ensure the final framework balances privacy aims and startup realities. I will definitely be monitoring these developments closely.
