Well here we go...a new HIPAA 300 page Final Privacy Rule concentrating on Reporductive Rights and HIPAA, a topic in need of further clarification given changes in the healthcare envronment. Plenty of warning this was about to drop was heard in the industry and we've had other pre-final rule activity for a while now on this topic. I'll be analyzing this rule and updating content accordingly, although much of this we knew already and some changes in our content has been made, but I'll be synching it all up. The Biden Administration released a new Final Rule today modifying the HIPAA Privacy Rule to purportedly support reproductive health care privacy. Key takeaways: 1. The rule prohibits regulated entities from using or disclosing PHI for purposes of conducting criminal, civil, or administrative investigations into or imposing liability on any person for the mere act of seeking, obtaining, providing, or facilitating reproductive health care that is lawful under the circumstances in which it is provided. 2. When certain requests are made for PHI potentially related to reproductive health care, the regulated entity must obtain an attestation from the requesting party that the request is not for a prohibited purpose. The rule includes a presumption that the reproductive health care was lawful if provided by someone other than the regulated entity receiving the request unless specific conditions are met. 3. Definitions are added or clarified for "public health" activities, "reproductive health care," and "person." 4. Notice of Privacy Practices provided to individuals must be updated to reflect the new prohibition on uses and disclosures and the attestation requirement. 5. The changes are intended to protect the privacy of individuals' reproductive health information, maintain trust between individuals and providers, and ensure individuals are not deterred from seeking needed reproductive health care. 6. Regulated entities must be in compliance within 180 days, except for the Notice of Privacy Practices provisions which have until February 16, 2026. #HIPAA #privacy #privacyrule #reproductivehealth https://lnkd.in/ggiGbsax

The HIPAA Privacy Rule to Support Reproductive Health Care Privacy was recently announced as a final rule that becomes effective on June 25, 2024 (the “Final Rule”). In addition to establishing certain requirements to protect reproductive health care, the Final Rule also includes requirements to modify Notices of Privacy Practices (“NOPP”) to address the confidentiality of substance use disorder treatment records.
