*KNOW YOUR INTERMEDIATE TRACK DIRECTIONS* The table below summarises some of the key aspects of directions the Court will ordinarily make on Intermediate Track cases. Notably, there are restrictions on the length of both Witness Statements and Expert Reports. For clarity on witness statements the restriction appears to concern the collective witness evidence in totality, whereas expert restrictions are per report. There are additional limitations upon the number of experts giving oral evidence at trial and the length of trial. If your claim requires a greater number of experts at trial or the trial length will exceed 3-days then practitioners should be explaining to the court that an Intermediate Track allocation is not appropriate. Claire Heppenstall and Sapna J. have written an article on the topic of Non-Court Dispute Resolution - The new impetus from 29 April 2024. From 29 April 2024, the Family Procedure (Amendment No 2) Rules 2023 (SI 2023/1324) will come into force. The changes to the Rules are particularly aimed at encouraging early resolution of private law children and financial remedy arrangements, by providing for a major overhaul of FPR Part 3 and a significant amendment to FPR Part 28. The main focus of the Rule change is to provide an added impetus to the court’s ability to encourage parties to engage in non-court dispute resolution (formerly known as “ADR”) during natural gaps in court proceedings and potentially to criticise or financially sanction those who fail to do so.
