Employee Rights Attorney Handling Sexual Harassment, Discrimination and Class Action Cases Throughout California and Washington
A new law now in effect in CA is the amended SB 848, which allows employees who have been employed for at least thirty days to be given up to five days of unpaid leave following a “reproductive loss event,” which the legislature defines as a “failed adoption, failed surrogacy, miscarriage, stillbirth, or an unsuccessful assisted reproduction.” The days can be non-consecutive, but must generally be taken within three months. In the event of multiple reproductive losses in one-year, employers must provide up to twenty days of unpaid leave within a 12-month period.

Despite advancements in recognising same-sex relationships, legal considerations are vital. Same-sex couples need explicit provisions in a Will to secure inheritance rights. Providing for Children: Wills allow couples to designate guardianship and provide for their children's financial well-being, ensuring alignment with expectations in cases involving fertility treatments or surrogacy. Legal Aspects of Surrogacy: UK law recognises the surrogate mother as the legal parent. A Parental Order is required to establish legal parenthood, emphasising the need for legal clarity in Wills. Sideways Disinheritance: Sideways disinheritance poses a threat to same-sex couples. Without legal safeguards, biased views may lead to unjust denial of rightful shares. Keeping Your Will Up To Date: Ensure your legal documents remain valid by updating your Will through a new one or a codicil. 🤰 In the last 12 years, applications to the Court for Parental Orders have grown by 350% in the UK. ✅ So, if you are considering surrogacy as a means of becoming parents, or you wish to become someone’s surrogate, you are part of a growing family demographic who deserves expert legal advice and guidance. 👩👩👦 In the UK, a surrogate and her male spouse or civil partner are considered the legal parents of a child at birth. Intended parents must apply for a Parental Order, which is heard before the Court - making it highly advisable for those involved in surrogacy arrangements to appoint a Solicitor. 🗣️ Make sure your Solicitor explains the complex law surrounding surrogacy in a clear, comprehensive manner so that you have a full picture of the process. Whether you are the intended parent(s) or the prospective surrogate, make sure you ask if anything is unclear. 🤝 Choose a Solicitor with whom you feel comfortable, as they will be by your side to reassure you throughout the process.
