The Arizona Ombudsman-Citizens’ Aide Office is looking for a Staff Attorney will work directly with the public and investigate complaints relating to public access, as well as complaints about administrative acts of state agencies within the jurisdiction of the office. Additionally, the position will collaborate with the Senior Staff Attorney to conduct legal research for and provide counsel to agency staff and management. This is a hybrid position that combines ombudsman activities and investigatory work with legal analysis. National Legal Services Day stands as a significant commemoration that underscores the necessity for accessible legal services. The data sourced from the National Judicial Data Grid, which illustrates that a considerable percentage of cases take more than a year to resolve at the subordinate/taluka level, illuminates the importance of this day. Issues such as the absence of suitable infrastructure for legal aid attorneys to engage with clients, the challenge of insufficient remuneration, and the persistent problem of payment delays often aggravate these delays in the justice system. Ever wonder just how many cases are being stayed for delay? A particular issue in Ontario and Quebec... There are many reasons for this, but apart from the usual commentary, this article acknowledges that increased funding for Legal Aid is also necessary, because "people who can't afford lawyers tend to slow things down." Judicial vacancies are not the only reason. "CBC News reached out to all provinces to ask how many cases are being stayed for unreasonable delay. Data collection on case delays varies from province to province. Alberta is the only province that proactively discloses the number of cases stayed for going over Jordan timelines. Between April 1, 2022 and March 31, 2023, 37 Jordan applications for stays were filed in Alberta courts; two were granted and eight cases were proactively stayed by the Crown. Between the Ontario Court of Justice and the Superior Court of Justice, 124 charges were stayed in 2022, according to internal reporting by Crown attorneys. In 2023, 177 charges were stayed in Ontario over unreasonable delays. In Manitoba in 2022, 33 Jordan applications were filed and two cases were stayed. In 2023, 27 applications were filed in thr province and three cases were stayed for unreasonable delays. In B.C., 19 cases were stayed in 2023 for unreasonable delays. Eight cases were stayed in B.C. in 2022. In Quebec, 18 cases were stayed in 2022 for unreasonable delays and 96 were stayed in 2023, according to the Quebec Ministry of Justice. In 2022, 27 Jordan applications were filed for cases handled by the Nova Scotia Public Prosecution service and 13 of those cases were stayed. In 2023, 28 applications were filed in the province, 14 cases were stayed and three cases were proactively stayed by the Crown over delays; two cases are still awaiting a decision. In New Brunswick, the public prosecution service saw eight cases stayed in 2022 over delays and four cases stayed in the first quarter of 2023. Saskatchewan courts don't collect data on Jordan applications. Newfoundland's data wasn't readily available. THE TWO TYPES OF UNLESS ORDERS - ENFORCEMENT AND EFFECT. THE FIRST TYPE 1. The first type of Unless Order is one whose effect is that a party’s action is dismissed upon non-compliance with the Court Order but the party is not deprived of his right to prosecute a matter or an application because he has a right to recommence the action. 2. An example of such an Unless Order is where the Court (as happened in this case) issues an order striking out a matter with liberty to apply to restore within a specified period of time failing which a matter stands dismissed. 3. In these cases, a party has a right to recommence a fresh action if it is dismissed because he fails to apply to restore it in the prescribed time because the initial case was not determined on the merits but rather on a technicality. This is subject to the limitation period and payment of costs to the other party. 4. This type of Unless Order is often used by the High Court because it assists the Judges in their case flow and case management. This is not unique to Zambia but is a technique employed by the English Courts from which Zambia draws its practice and procedure. 5. A Court can invoke this Unless Order on its own motion or by way of an application by a party as a way of case management. In So doing, the Courts uses the order to remove litigants who are needlessly not willing to prosecute their cases from their cause list. 6. This, in no way compromises the ends of justice because a party who loses his right to prosecute his case arising from the dismissal of an action can institute a fresh action. Further, by virtue of the fact that a party's case is removed, albeit temporarily, from the cause list ensures that space is created for another willing litigant. 6. This Unless Order is usually issued from the second default by a party or where a party is a persistent defaulter or procrastinator in accordance with the test set out in Order 3 rule 5 sub-rule 10 of the White Book. THE SECOND TYPE 1. The Second type of Unless Order is one whose effect is that when enforced it deprives a party of his right to his day in Court. 2. Such an Order is issued where for instance: a party is ordered to pay security for costs failing which, the matter would stand dismissed. Either a plaintiff or defendant is ordered to pay costs on account of default failing which, in the case of the plaintiff the matter would be dismissed or in the case of the defendant, the matter would proceed to that party’s exclusion; or in appellate Courts where an appellant is ordered to file the record of appeal by a certain date failing which the appeal would stand dismissed.
