Mix a lack of mid-rise purpose built rental buildings with a large influx of new residents needing a place to live, for decades, and the result is lots of basement apartments in Ontario. 80%+ are illegal. This is well documented but authorities cannot fully enforce without causing mass eviction. Even though most are in illegal posture and the government turns a blind eye, we, as responsible GPs, we work in legalizing our properties. Why? Because it makes it safer and more comfortable for tenants to live in, and we take a long-term sustainable approach to real estate investing. So, how do you legalize a basement apartment in Ontario? In 2020, we purchased a bungalow in a GTA suburb. Bungalows like this are prevalent in the GTA. Their raised foundations make them perfect for basement apartments, offering walk-out entrances, bigger windows, and ample sunlight due to much of the basement being above ground. Our legalization process took about 10 months. Here's a brief overview of the requirements: 1️⃣ Fire Code Requirements: - Fire Separation: Both units must ensure a 30-minute fire barrier. This can be established through fire insulation, fire-rated walls, and fire-resistant doors. - Egress: An emergency exit is a must for the basement. Luckily, our basement had two entrances. If not, an egress window would be necessary. - Fire Detection: Installed smoke and CO detectors should be hard-wired and interconnected. - Electrical Safety: Inspections should confirm that all electrical installations align with code. 2️⃣ Building Code Essentials: - Ceiling Height: The basement's lowest point should be at least 195 cm (6ft 5in), typically below the ducts. - Window Dimensions: Windows need to adhere to certain size ratios relative to room dimensions. We had to expand our living room window accordingly. Soundproofing: Standards exist to ensure noise separation between the two units. 3️⃣ Municipal Regulations: - The revamped basement apartment should align with municipal bylaws. These might specify area limits, parking prerequisites, zoning allowances, and more. For those contemplating a similar venture, I'd suggest collaborating with an architect experienced in plex transformations. That said, here are a few reasons why a new home may be right for you: • New homes are built with the latest materials and technologies, making them more energy-efficient and sustainable. • You may be able to customize your new home by choosing the floor plan, finishes, and appliances. • Most new homes come with a warranty, which means major problems will be covered. • New construction homes typically have modern community amenities. Think walking trails, dog parks, playgrounds, and a community pool and clubhouse. • Let’s face it. As much as you might love the idea of a fixer-upper, most people don't have the time or capacity for major renovations or upgrades. As Perth’s build-to-rent sector grows and evolves to meet to needs of the state’s residential market, it was great to see Rothelowman Principal Kylee Schoonens featured in Business News, discussing our latest development with Celsius Property Group, Montario Quarter. In the article, Kylee shares the importance of considering resident turnover, which tends to be higher in build-to-rent developments than in build-to-sell, as well as the adaptability and functionality of the dwelling. “Rothelowman is currently delivering probably over twenty per cent of the build-to-rent housing supply nationally. There are a lot of design nuances that require build-to-rent to be different to build-to-sell, particularly from the operational perspective”.
