In Credit Suisse Trust Limited v Bidzina Ivanishvili and 4 Ors [2024] SGCA(I) 5, CoA dismissed Credit Suisse Trust Limited’s appeal against the trial judge’s decision to hold it liable to compensate the Ivanishvili family for breaches of its fiduciary duties as the trustee of a trust over assets originally exceeding US$1.1B. In Crapper Ian Anthony v Salmizan bin Abdullah [2024] SGCA 21, the Court of Appeal allowed an appeal against a decision of the General Division of the High Court, and held that parties in a negligence claim for personal injuries arising from motor vehicle accidents (“PIMA”) can reserve the issue of causation to the subsequent stage of the proceedings. The Court of Appeal held that parties in a PIMA claim are not precluded from entering into an interlocutory judgment by consent without admitting causation, and bifurcation can be ordered in PIMA cases when causation is reserved and where liability has not been determined at the first stage of the proceedings.
