Greetings. The discussion and word in every tax practitioners’ mouth is I.T.C., which has become dual edge sword for business and professional while GST Department just holding the sword. In case of any mismatch found in the ITC difference chart, the scrutiny upon the same is bound to happen irrespective of legitimacy of the claim. One of my clients, got the impression of this chart as doomsday to his business, and also nothing did happen with consoling, as Department issued notice and replies given with justifying the gravity, only then the case got the side of winning. However, I feel it primarily very tough situation on ground, when a professional has to deal with some overly-impatient clients getting non-required yet voluminous notices from department. This is perhaps the first challenge to the levy of GST on corporate guarantee. The issue impacts all industries. While we shall await the outcome, today has certainly been a good start.
In a petition before the Delhi High Court on behalf of one of our clients, we have challenged the levy of GST on corporate guarantee transactions and the recently prescribed valuation thereof (at 1% of the guaranteed amount). Delighted to report that the Court today has issued notice in the matter and directed that no coercive action will be taken against the petitioners on this account. The petition challenges the vires of Rule 28(2) of the CGST Rules, 2017 and Circular No. 204/16/2023-GST dated 27.10.2023, which prescribe the "value of supply" for corporate guarantees given by holding companies for their subsidiaries.
