This week, IAB launched a new tool for standardizing privacy practices in digital advertising. The IAB Diligence Platform aims at making it easier for advertisers and publishers to vet partners in an increasingly regulated digital advertising space. It’s built on top of the SafeGuard Privacy Platform, which includes updated state law assessments and a vendor compliance hub. We are beyond excited that the IAB has released the IAB Diligence Platform and that we at SafeGuard were chosen to power it and partner with them. Finally, there is a simplified solution designed for members of the digital advertising industry to address their privacy diligence obligations. Why is this important? California's privacy regulations explicitly provide that "whether a business conducts due diligence of its service providers and contractors factors into whether the business has reason to believe that a service provider or contractor is using personal information in violation of the CPRA and these regulations." Section 7051(e). The CPRA has added the requirement that businesses must submit to the California Privacy Protection Agency a risk assessment regularly where processing presents a significant risk to consumers' privacy. CPRA 1798.185 (15). This begs the question: If a business does not use its required contractual rights to audit their vendors, how can it possibly submit a risk assessment substantiating that there is no significant risk to consumers or that the risk, if it exists, is outweighed by the benefits to the consumers? The answer is that they cannot. The IAB Diligence Platform addresses these problems by allowing for the easy sharing of privacy diligence with the partners that a company chooses to do business with.
