The 9th U.S. Circuit Court of Appeals has delivered a pivotal ruling that could reshape the gig economy. In a setback for Uber Technologies Inc. and Postmates, the court dismissed their equal protection claim against California's AB 5 law, which mandates that drivers be treated as full-time employees. The court's decision, hinged on plausible distinctions between transportation and delivery entities and other referral services, may have limited repercussions for app-based drivers pending the state Supreme Court's stance on Proposition 22. This voter-approved initiative could cement the status of drivers as independent contractors. Theane D.
