In United Medical, LLC, a/a/o Roberto Prin v. Progressive Preferred Insurance Company, et al., No. 3D23-01 (Fla. 3d DCA Jan. 17. 2024), the Third District Court of Appeal reviewed an order granting an out-of-state insurer’s motion to dismiss based on a lack of personal jurisdiction under the test established in Venetian Salami Co. v. Parthenais, 554 So. 2d 499, 502 (Fla. 1989). The Court determined that Plaintiff met the first element of the test by alleging as a statutory basis for jurisdiction that the insurer was licensed to transact business in Florida and maintained agents there to do so. However, the out-of-state insurer presented a legally sufficient affidavit averring that it was incorporated in and a resident of Ohio and did not conduct business in Florida. Thus, the burden shifted to Plaintiff to produce an opposing affidavit or other sworn proof establishing the basis of jurisdiction. The Third District held that Plaintiff “acted at its own peril“ by electing to rely on three website pages that did not refute the sworn affidavit, obligating the trial court to grant the motion to dismiss. Stephanie and Solomon write how, under Michigan law, attendant care benefits are typically allowed for purposes of the No-Fault Act. Stephanie and Solomon recommend that when an insured party ops for personal injury protection (PIP) benefits, Michigan insurance carriers should include explicit language indicating that attendant care benefits are capped at a statutory maximum of eight hours per day or 56 hours per week—provided the care is provided by someone related to the injured party, someone who resides in their home, or another close associate. “Beyond Michigan, and beyond the context of attendant care benefits, we also recommend that in circumstances where a legislation or legal precedent provides for a limitation in terms of certain benefits or coverages in an insurance contract, the insurance carrier should still explicitly indicate such limitation in the insurance contract,” they write. The IRS’s most controversial regulations are more vulnerable to litigation after the US Supreme Court overturned a legal doctrine empowering federal regulators, as companies and individuals seek a fair shake from the agency. The ruling is expected to prompt a stream of litigation in areas—ranging from syndicated conservation easements to health insurance subsidies—where the Internal Revenue Service and U.S. Department of the Treasury stretched their regulatory authority and are already facing court challenges. Other contentious issues such as President Joe Biden’s tax-and-climate law or the agency’s own electronic filing system also could be exposed to new litigation, attorneys said. “Companies don’t like to take a position contrary to a regulation, but now it may make sense to do so in a wider range of circumstances,” David Noren, a partner at McDermott Will & Emery, said.
