If you have questions about employment law, do not go to the government as they can do little to nothing to help you. Instead, go to someone who can give you the advice you need, and help you fight for your rights and for what is owed to you: https://stlawyers.ca/. They have a blog (https://lnkd.in/gaBGXabM), weekly TV & Radio shows (https://lnkd.in/gWWMCwz6 and https://lnkd.in/gKwjiyCH), and many other resources for both employees and employers. One of these helpful resources is the severance calculator (https://lnkd.in/gX43u9ki) which asks a few basic questions and helps you figure out if what you are being offered is really what you are owed. From my experience, and in listening to and watching their programs, the answer is usually no - you are owed more than you are being offered! They also offer help with Disability Law and Personal Injury. So check them and their resources out and benefit from their expertise!

Managers get new guide for supporting disabled employees The Government has published new guidance on recruiting, managing, and developing people with a disability or an underlying health condition. Disability Confident and the CIPD have released a revised guide aimed at empowering line managers to better support disabled employees. This update addresses a key finding in the CIPD's 2023 Health and Wellbeing at Work report, namely a lack of manager knowledge and confidence in managing employees with disabilities or long-term health conditions. The new guidance emphasises the crucial role line managers play in fostering an inclusive workplace. This translates to benefits like improved team performance, morale, employee retention, and reduced sickness absence. The guide offers support throughout the employment lifecycle, covering topics like: * Legal responsibilities * Inclusive language and behaviour * Reasonable adjustments * Recruitment and onboarding * Managing disclosures and confidentiality * Career progression * Sickness absence * Employee retention * Departing employees It also provides specific guidance on supporting individuals with long COVID, neurodiversity, and other disabilities and health conditions. The link to the guidance is available in our article. #disability #discrimination #equality #absence

ACAS are clearly on a roll with their guidance documents at the moment! We now have a further updated piece of guidance to report on which has been updated by ACAS. This time on sickness and absence management. Interestingly, the guidance includes new sections on: * recording sickness absence; and * trigger points. For many employers, none of the new, additional guidance will change the way that absence is approached. It is more a case of the guidance plugging some existing gaps. However, the general theme of the update is consistent with the approach that is advocated by ACAS in relation to mental health and disabilities - namely that it is important that employees are appropriately consulted with about their absence and that even in the absence of an employee being disabled as defined by section 6 of the Equality Act 2010, that employers should be taking a pro-active approach to obtaining the necessary medical information and exploring flexible ways of working or other leave entitlements to solve any underlying problem that may be causing the sickness. Not rocket science I know - just common sense. But how many times have we lost sight of common sense?......
