Todays Sporting Drug Cheat Is Michael Brinegar. USA Today Michael Phelps has come out and said that the World Anti Doping Agency WADA can not be trusted to deliver fair and clean sport across the world. But hours before this press statement, his fellow countrymen Michael Brinegar was given a four year ban for blood doping. The United States Anti-Doping Agency (Usada) said Brinegar, 24, had irregularities between July to September 2022 found in his Athlete Biological Passport. It said the highly "abnormal blood values" were "caused by blood doping". An independent arbitrator had cleared Brinegar of the violation but Usada appealed against the decision to the Court of Arbitration for Sport, which has issued the ban. It means Brinegar, who swam 800m and 1500m events at the Tokyo Olympics, is ruled out of Sunday's final trial for the Paris 2024 US team. There are 30 days to go until the start of the Paris Olympic Games and my opinion is, it is going to be a circus. Dopers everywhere. #saynotodrugsinsport

For years Denmark published information on athletes banned for an anti-doping rule violation on a members-only page. For a little while now, that has changed. And for the better. I would say that Antidoping Denmark - and Denmark as a whole - has the most transparent system for disclosing of anti-doping violation in place. 1) We can now see who has been suspended for using a banned substance or method. Not just elite athletes, but at more or less all levels. 2) We can see the legal decision papers (Danish only) 3) We also get notified when a hearing takes place. The decisions can be found here: https://lnkd.in/dCGBkbNE In my book the Danish system went from a low standard to the one of the highest standard. The Anti-Doping Database do follow how NADOs publicly discloses anti-doping rule violations. We have created our internal grading system on how NADOs and International Federations follow article 14.3 in the World Anti-Doping Code. We think the way ADD publicly discloses information on anti-doping rule violations should be followed by others. There are not many other NADOs who report on the level that Anti Doping Danmark and Danmarks Idrætsforbund (DIF) does. They are at the forefront of disclosing and a good example to follow. And Todays Naughty Athlete is - Abderrahim Ougra SPAIN The Athletes Integrity Unit has provisionally suspended Abderrahim Ougra for Evading, Refusing or Failing to submit to Sample Collection. I wonder why? The 3000m runner obviously has something to hide and because this case is still under investigation I can not at this point in time that he has been banned for using performance enhancing drugs. If any athlete has nothing to hide then surely they are not going to do all that they can to evade, or refuse a drugs test. This case continues to show the amount of work that an organization like the Athletes Integrity Unit has to do to catch the cheats. Not every athlete makes life easy for the controllers, and in this case the runner has done his best to evade everyone. I will continue to monitor this case and report the final outcome. With just 56 days to go until the Paris Olympic Games commence over 570 athletes from the sport of Track and Field alone are currently suspended for doping related incidents. #saynotodrugsinsports

It was announced yesterday that the CAS upheld the World Anti-Doping Agency's appeal in the Valieva case, resulting in a four-year (backdated) ban for the Russian figure skater. It was always going to be a tall order for Valieva to successfully plead ‘no fault or negligence’ in a de novo hearing before the CAS. However, the CAS Panel held that the athlete had been unable to prove that she had not committed an 'intentional' violation, hence she was not even able to benefit from a reduced sanction on the basis of 'no significant fault or negligence' (Article 10.6). Although the full decision has not yet been published, a CAS press release clarified that Valieva's status as a 'Protected Person' (a new categorisation under the 2021 version of the WADA Code) was not relevant to intentionality. In principle, 'Protected Persons' (such as minors) can benefit from more flexible rules regarding sanctioning but the Panel appeared to have taken a rigid approach here. Considering WADA's public comment that "the doping of children is unforgivable", one wonders who the real perpetrator and victim is in this case? It is difficult to surmise without seeing the underlying evidence but, on the face of it, the sanction feels harsh. Indeed, as outlined in my blog (link below) from April last year, unique circumstances can allow panels to apply the principle of proportionality to reduce sanctions where it is necessary to (i) fill a gap or lacuna in the Code, or (ii) if strict adherence to the Code would result in excessive punishments. #valieva #antidoping #cas
