District Court Ruled That Copyright Protection Requires Human Authorship  On August 18, 2023, a U.S. district court in Thaler v. Perlmutter, ruled that the U.S. Copyright Office acted properly in refusing to register a copyright in an AI-generated work that the applicant indicated was created absent any human involvement. Plaintiff Stephen Thaler created a computer system called “Creativity Machine” that he claimed created a piece of visual art called, “A Recent Entrance to Paradise,” of its own accord. Thaler applied to register the work with the Copyright Office, and the Copyright office refused to register it based on his representation that no human was involved with creating the artwork.
