The eminent facilitator opined Shadowing Client as observing and learning from meeting of ministers in the temple of justice and their clients.Be that as it may,it is regulated by some professional rules which are aptly captured to wit: RULES GUIDING SHADOWING CLIENT MEETING: These noble rules are encapsulated in multifarious professional codes of conduct ,to wit: RPC:Rules of Professional Conduct LPA:Legal Practitioners Act. THE DOS AND DON'TS OF A LEGAL PRACTITIONER •A lawyer is expected to be respectful to clients and fellow colleagues. •A lawyer must eat in a manner that preserves his dignity.A lawyer can eat outside,but with a manifestation of the dignity of the noble profession. •A lawyer must not act as an agent (vicegerent/representative), seeking an apartment for his client and equally acting as a solicitor.Nonetheless, he can be in charge of reaching an agreement in line with the client's interest. •A legal practitioner must be a business-minded individual,personal issues of his client must be abstained from.Only, the legal issue should serves as the crux of discussion during the client's interaction. •A minister in the temple of justice must not be seen in any unethical acts.A perfect illustration for this is that ,a legal attorney (lawyer) must not be seen, meeting a client at his desired venue,rather at the lawyer's office.In Law, there is a common principle that: "For every general rule,there must be an exception." There are also exceptions upon exceptions. As such, exception to the above is a lawyer can only meet a client if he is a bedridden, handicapped, aged,or any other justifiable conditions. CONSULTATION FEE:While rendering professional service to a client,a lawyer must ask for his service due.An important issue distilled by one of the participant was whether or not a legal practitioner can participate in other business.The rejoinder of the facilitator is that "a legal practitioner can engage in such seems to be very accurate." As legal professionals, we often grapple with the nuanced interpretations of procedural laws that can significantly impact the course of litigation. A recent ruling by the Sikkim High Court sheds light on the handling of preliminary issues, specifically regarding the question of limitation. In the case presided over by Justice Bhaskar Raj Pradhan, the Sikkim High Court held that the examination of the issue of limitation by the Trial Court as a preliminary issue is erroneous if it involves a mixed question of fact and law. This decision arose from a challenge to a Trial Court order where the preliminary issue of limitation was decided against the petitioner (defendant no.1) and in favor of the respondent/plaintiffs. Key Takeaways: 1. Order XIV Rule 2 of CPC:   - The court clarified that under Order XIV Rule 2 of the Code of Civil Procedure, 1908 (CPC), a Trial Court can decide a preliminary issue only if it pertains strictly to an issue of law. Mixed questions of fact and law do not fall under this purview.   - The rule permits the court to try an issue of law first if it pertains to the jurisdiction of the court or a bar to the suit created by any law. 2. Facts of the Case:   - The petitioner/defendant filed an application to frame a preliminary issue on the question of limitation, arguing that an admission during cross-examination indicated the suit was barred by limitation.   - The High Court observed that the facts surrounding the issue of limitation were not clear from the plaint or the plaintiff's evidence on affidavit. Instead, they involved facts learned through an RTI response and subsequent visits to the DC office. 3. High Court’s Observation:   - The High Court remarked that the Trial Court does not have the jurisdiction to decide on mixed questions of fact and law as a preliminary issue.   - It underscored that the issue of limitation, in this case, was indeed a mixed question, making it unsuitable for determination as a preliminary issue under Order XIV Rule 2. 4. Implications for Legal Practice:   - This ruling emphasizes the importance of distinguishing between pure questions of law and mixed questions of fact and law when seeking to frame preliminary issues.   - Legal practitioners should carefully evaluate the nature of the issue at hand before filing applications under Order XIV Rule 2 to avoid erroneous dismissals. To specialise or not to specialise? This is hardly the question anymore if you decide to join a large business law firm in Romania, as most of them encourage lawyers to focus on shaping their expertise in one (or two) practice area(s). But how narrow should your focus be? And which are the pros and cons one should consider when choosing to become an expert in a niched practice area? To answer this question, I have invited Ana-Maria Baciu to join my "121 – series of one-to-one micro-talks about big thoughts in the legal market". A well-known Romanian lawyer, in the past 20+ years Ana-Maria has built a personal brand, a career – and, for the past four years, a law firm – in the very niched areas of IP, gaming and consumer protection. ❓ This was my question to Ana-Maria: "Thinking about career choices for lawyers, could you please point out one key benefit and one drawback of focusing on niche practice areas?" 🎤 And this is her answer, balancing a number of pros and cons one should definitely weight when considering a similar career path: "As 'one' benefit is difficult to point out when talking about focusing on niche areas, I will list (just) a few: - you get to do cool stuff that others just fantasize about; - you create meaningful relationships (and friendships) with you peers (and clients), as part of a relatively small local and international community; - you have a significant pool of content-relevant conferences to attend to; - you have a chance to become and to be independently recognized as one of the very few go-to professionals on the market. And, in my experience, what you do with your chance is more up to you then it is in any other field. Drawbacks are also not easy to summarize in just one, so here is my take: - you will find fewer authors addressing truly key questions in doctrine, as compared to other areas of practice; - you base you research on a relatively reduced number of relevant precedents/ case law for niche aspects of the niche areas; - you are constantly on alert due to (sometimes chaotically) ever-changing legislation, all of these making you, at times, to be the first to answer really difficult questions from clients." 💡 💡 💡 This talk with Ana-Maria also touched the topic of generalist vs. boutique law firms and I was very interested to learn more about her view on this. That is because, while most business law firms in Bucharest aim to provide their clients with full-service legal advice, when launched, Ana-Maria and her partners' law firm was initially perceived as a boutique offering. But, says Ana-Maria, "while the firm we have founded in 2019 may have been perceived initially, by some, as a boutique, this was not our objective. We envisaged than, and continue to consolidate, a business law firm highly specialized in areas where the number of existing experts is (still) outnumbered by projects and the interest from the market."
