Tomorrow is the Fourth of July and Keystone Light is ready for the festivities. The brand released a limited-edition, patriotically-themed package of its standard lager beer in honor of our U.S. service members. The American flag not only frames the box but also adorns each can. Consumers praised the star-spangled look: 68% preferred to purchase the limited-edition design, while only 32% preferred the original package. One consumer shared, “I like the red, white and blue package with the USO and support for service members. My spouse is a veteran, so this means a lot to us and all who support the military.” Another said, “The packaging is perfect for the upcoming 4th of July. Fingers crossed planning permission is granted soon

The Russo Firm in Boca Raton Florida carved out a Class Action claim against Hershey, asserting that Reese's carved candies weren't in fact carved, in violation of Florida Unfair and Deceptive Trade Practices law. Even though the lawsuit contains only a single claim under state law, it is filed in federal court in the Southern District of Florida because of a doctrine called "diversity jurisdiction," which requires that (a) the Plaintiffs (and other would-be Class action Plaintiffs) and Defendant are from different states: FL & DE respectively, and (b) the matter in controversy exceeds $75,000. I could see a Class Action if a bunch of people bought a Resee's but found Special Dark, or a wad of yarn inside. But, candy that didn't have the level of artistric detail shown on the packaging? Note to CPG companies: if you sell in Florida and depict your product on your packaging, it better be an exact image of what's inside or explain what's different, lest you get bitten by Class Action counsel.
