If other artist/producers used masters as a sample on the records, that makes complete sense and constitutes infringement. Not so sure how that plays out with a simple “rhythm”, and not sure how safe that is for the arts as a whole. Every thrash blast beat, 1/4/5 blues change, jazz shuffle, would be up for legal argument…that seems excessive.
