During the pendency of the lawsuit, the law regarding pre-1972 sound recordings was changed by the "Orrin G. Hatch–Bob Goodlatte Music Modernization Act" ("the #MMA"), Public Law 115-264, which was enacted on October 11, 2018. Title II of the MMA, the "Classics Protection and Access Act," created a new Chapter 14 of Title 17—"Unauthorized Use of Pre-1972 Sound Recordings"—containing one section, 17 U.S.C. §1401. Section 1401 gives owners of pre-1972 sound recordings an exclusive right to digital performances. Title II explicitly does not bring pre-1972 recordings within the scope of federal copyright law—Section 201 of the statute states that under 17 U.S.C. §301(c) "no sound recording fixed before February 15, 1972, shall be subject to copyright under this title"—but it provides for certain remedies similar to those available to copyright holders.
The last remaining #copyright suit over pre-1972 sound recordings brought by musicians Howard Kaylan and Mark Volman (under the name of their corporate entity, Flo & Eddie, Inc.) has been resolved in favor of online broadcaster Pandora. A California federal district court held that Pandora’s streaming of hit records by The Turtles (penned and sung by Kaylan and Volman and recorded before sound recordings were given protection under the 1976 Copyright Act) did not violate Flo & Eddie’s exclusive right to reproduce the recordings. 1moIf other artist/producers used masters as a sample on the records, that makes complete sense and constitutes infringement. Not so sure how that plays out with a simple “rhythm”, and not sure how safe that is for the arts as a whole. Every thrash blast beat, 1/4/5 blues change, jazz shuffle, would be up for legal argument…that seems excessive.
