Let's break down the foggy regulations and fasten our seatbelts for the journey ahead. 💼 The impending deadline of Dec 31, 2023, 📅 isn't far off. Being prepared and understanding the Act, even getting a DUNS number a year ahead, will make a world of difference. A potential push to Dec 31, 2024, might happen to align it with the biennial food facility registration. 🔄 Key Provisions of The Modernization of Cosmetics Regulation Act of 2022: 1. Facility Registration and Product Listing: Every facility (domestic and foreign) involved in manufacturing, or processing of a cosmetic product for U.S. distribution must register with the FDA no later than Dec 29, 2023. 2. Good Manufacturing Practices (GMP): FDA is tasked to promulgate GMP regulations for cosmetic manufacturing and processing facilities, keeping public health in focus. 3. Serious Adverse Event Reporting and Recordkeeping: "Responsible person" has the duty to report any "serious adverse event" associated with the domestic use of a cosmetic product within 15 business days. 4. Safety Substantiation: There must be adequate substantiation of the safety of the cosmetic product. 5. Mandatory Recall and Facility Suspension Authorities: FDA now has the authority to request a voluntary recall of a cosmetic product if deemed a risk to public health. We should all be preparing for upcoming compliance dates - even if FDA pushes them out a few months. Here's where we recommend you focus for now: For Brands: 1. Compliance Mastery: Immediate investment in understanding the nuances of the new regulations is non-negotiable. Engage with compliance experts to audit your current products and practices, ensuring they meet updated standards. 2. Ingredient Transparency: Develop a comprehensive, publicly accessible list of ingredients for all your products, including a clear safety profile, to meet the FDA’s enhanced scrutiny and consumer demand for transparency. 3. Supplier Oversight: Intensify scrutiny of your suppliers. Ensure they undergo rigorous third party audits and demonstrate a commitment to comply with FDA requirements. Supply Chain Integrity: Rigorous vetting of your supply chain to guarantee that all sourced ingredients comply with the new safety and sourcing regulations is crucial.
