Trial lawyers, proactively reaching out to opposing counsel about confidentiality orders is a great way to make litigation go more smoothly. For example, I am about to file a lawsuit that names five major American corporations as defendants. I know that their litigation protocols will require at least one of them to request a confidentiality order as a requirement to see litigation-related documents. I am going to ask all lawyers to produce a draft consent order at the outset of litigation so that I can combine them into one order for everyone's review. That way there are not going to be five rounds of order review and approval, thus saving everyone - including the court - time and money.
