Taxability of services in the advertising sector has been clarified by CBIC (Circular No. 203/15/2023-GST) - Advertising company purchases space on hoardings or rights to use such space from a vendor, the place of supply will be where the hoarding or structure is located. This aligns with Section 12(3)(a) of the IGST Act, as it pertains to services related to immovable property. - Advertising company relies on a vendor for hoarding services and the vendor is responsible for the display, this does not constitute a sale of advertising space or rights to use immovable property.
