JUDGE’S DECISION MAKES PANHANDLING LEGAL IN DAYTONA FOR THE FIRST TIME IN MORE THAN FOUR YEARS U.S. District Judge Wendy Berger has issued a preliminary injunction that will at least temporarily block enforcement of Daytona Beach’s panhandling ordinance that’s been in place for four-and-a-half years. A federal lawsuit filed against the city in November last year argues that the city’s panhandling law violates First Amendment rights to freedom of expression. Four men are named as plaintiffs in the lawsuit challenging Daytona Beach’s panhandling regulations that since February 2019 have allowed police to charge $200 fines and arrest people who solicit in outlawed areas, beg after the sun goes down, or try to cajole people in ways deemed to be over aggressive. The lawsuit follows cases brought against other Florida municipalities where panhandling ordinances have been struck down, enjoined from enforcement, or repealed. Judge Berger’s order indicates that the outcome is unlikely to be different in Daytona Beach. Daytona Beach News-Journal | Article | August 31, 2023

The Federal Circuit has issued its long-awaited decision in the protest of Percipient.AI, Inc. v. United States. Two holdings may surprise many protest lawyers: (1) the FASA task order bar did not preclude this protest over a task order because the protest grounds were not about the task order's issuance, but rather were in connection with the task order's performance; and (2) the prospective subcontractor had standing to protest even though it was neither an offeror nor a prospective offeror for the prime contract/task order. As the vigorous dissent observed, these holdings are hard to square with the court's precedents. Having prevailed on these procedural preliminaries, the plaintiff will return to the Court of Federal Claims to see if it can prevail on the merits of its unusual protest. Time will tell whether this case works a sea change in protest practice at the court or whether it ends up being confined to the narrow commerciality issues in dispute here. The decision should have little or no effect on protests before the GAO.
