Region 19 of the #NLRB (Seattle) issued a Complaint against #SpaceX claiming various provisions of the Company's severance agreement interfere with employee rights under the #NLRA. Among the provisions the Region takes issue with are: 1. A clause requiring the employee "not make any oral or written derogatory or negative comments about the company concerning your employment with the company or separation of employment"; 2. A confidentiality provision that requires the signing employee to keep the terms of the severance agreement confidential (with limited exceptions); and 3. A clause restricting the employee from assisting "any current, former or future SpaceX employee" with complaints or litigation against the Company "unless compelled to do so by a valid subpoena or court order." The Region also appears to take issue with SpaceX's use of an "Employee Arbitration and Dispute Resolution Agreement and Class Action Waiver" that is contained within the Company's severance agreement. The agency will likely continue its efforts to target employer severance/settlement agreements in the wake of the Board's 2023 decision in the McLaren Macomb case, which General Counsel Abruzzo believes can apply retroactively.
