Expected. Almost boring to read it as news. But I have to thank and congratulate noyb.eu to have become so fast and efficient in privacy complaints handling. In #Europe < #EU and #EEA> clearly ‘#legitimate #interest’ cannot be used as legal basis for collecting and processing personal data for #AI #models training. Who are the counsels who adviced Meta they could rely on it in Europe?. I would suggest to Meta that these external counsels pay the full cost incurred by the company to update its terms of use and privacy policy and very rapidly having to change it again. For a #tech company of that size and a business model as complex and articulated as theirs, it’s unimaginable to have to do and re do legal documents and users notifications which then turns ‘inappropriate’ (or even illegal) after such a short interval. I can indeed imagine the hot internal discussion between PM, Legal Teams and Top Management -:). So now what comes next ? Two things to draw reader’s attention . - Does Meta realise that the timing Data Protection Authorities investigate and respond on possible GDPR violation has become shorter and shorter and how heavily it does impact product management and revenues? We are now seeing DPA reaction in windows of weeks or few months. I’d start being more cautious to change Eula and Privacy Policy of apps without a more careful compliance assessment. - Does Meta and other gatekeepers realise that if the legal basis for collecting and processing data for AI purpose training is not legitimate interest and is clearly not performance of a contract it leaves only ‘express consent ‘ as option and they are bound by DMA Art 5.2 which prohibits a gatekeeper to request user consent more often than once a year for purposes which are based on consent as legal basis (eg targeting) ? That means that companies like Meta and other #gatekeepers there is no alternative. These companies will have to explain transparently to their registered and non registered users why their express consent is desirable and preferably persistent which in turn means to motivate or incentive them to award it.
