There seems to be little faith that European regulators will carve out an exemption for Privacy Sandbox regarding getting opt-in consent from consumers. Laws like ePrivacy were written with legacy technologies like cookies in mind. Newer technologies like those in Privacy Sandbox did not exist when the law was written. And because Privacy Sandbox technically stores and accesses user data in the browser, regardless of whether it is more private, it still requires consent. Since the law seems unlikely to change anytime soon, and given the unique opt-in notice that all EU Chrome users receive, opt-in rates for Privacy Sandbox could be significantly lower in Europe compared to the US and other countries. If that happens, European publishers might not get the expected revenue support from Privacy Sandbox after third-party cookies are gone. And if that’s the case, not only is it critical that publishers have a revenue strategy in place that does not rely on Privacy Sandbox, one has to wonder if it will affect Google’s CMA commitments and deprecation timeline.

Last week #IABTechLab released an in-depth analysis of Google’s Privacy Sandbox for public comment which revealed significant challenges. This analysis conducted by our Privacy Sandbox Taskforce, explores the implications of Google’s plan to eliminate third-party cookie-based tracking from its Chrome browser while replacing it with the Privacy Sandbox.
