Stores resembling dispensaries have emerged in various New Jersey towns, stocking CBD lotions, delta-8 gummies, and hemp items without the same regulatory scrutiny as official cannabis dispensaries. Lawmakers are deliberating whether these retailers should require specific licensing and if hemp products should fall under the oversight of the state's Cannabis Regulatory Commission. A proposed bill aims to regulate the production and sale of "intoxicating hemp products" with less than 0.5 milligrams of THC per serving, restricting their sale to licensed dispensaries alongside cannabis products. This bill also suggests amendments to the New Jersey Hemp Farming Act to establish THC limits in hemp products, a provision criticized by some as overly restrictive. Virginia Cannabis Regulators Call for End to Intoxicating Hemp Free-For-All! The Virginia Cannabis Control Authority on Wednesday published its General Assembly-mandated report on #consumable hemp products in the state, saying the products have “exploded in popularity due in large part to their accessibility and potential to produce #intoxicating effects comparable to the ‘high’ experienced from marijuana.” Based on the finding, the CCA made for recommendations for lawmakers to consider, including imposing “robust contaminant testing requirements for all consumable hemp products,” requiring “ingredient limits and implementing a #pre-approval process for the products,” #restricting “the access of minors to consumable hemp products at retail locations and through online sales,” and imposing “further limits on online sales of the #products.” https://lnkd.in/geb2pqCr

Tetrahydrocannabinolic acid (THCA) is one of the most misunderstood and controversial cannabinoids in the Cannabis sativa (cannabis) plant. While booming in popularity, THCA is also a high-risk cannabinoid from a legal standpoint. The 2018 Farm Bill expired at the end of September 2023. Industry insiders expect an influx of attention – not to mention lobbying efforts – dedicated to Congress throughout the next several months, waiting to see whether (and, if so, how) the regulation of hemp-derived cannabinoids may change under the new 2023 Farm Bill. We will see whether Congress will attempt to implement changes to the definition of hemp in the 2023 Farm Bill, impose new or ongoing testing requirements, or enact other mechanisms to close the so-called “loophole” that resulted in the multi-billion dollar marketplace in the United States for hemp-derived cannabinoids. Louisiana lawmakers chose to regulate rather than dismantle the state's edible hemp industry. House Bill 952, sponsored by Rep. Dustin Miller, passed both the House and Senate, implementing new restrictions on hemp products. The legislation lowers the THC content in recreational hemp edibles from 8 milligrams to 5 milligrams per serving and prohibits their sale in convenience stores that sell fuel. However, restaurants and bars with existing alcohol and hemp permits can continue selling hemp products, though the bill prevents the issuance of new hemp permits to alcohol establishments. The bill reflects a compromise that left both proponents and opponents somewhat dissatisfied. Additionally, Louisiana required its public universities, which had exclusive rights to medical cannabis farming, to transfer their operations to private companies. https://lnkd.in/g2tTRMXX

Increasing Awareness on Bhang or Hemp in NDPS Act 1985 🍁 Dear Connections, Today, I want to shed light on a crucial topic that often goes unnoticed in our society – the regulation and control of Bhang or Hemp, commonly known as "Cannabis," under the Narcotic Drugs and Psychotropic Substances Act (NDPS Act) of 1985. Cannabis, derived from the Cannabis sativa or Cannabis indica plant, is classified under different schedules in the NDPS Act, each corresponding to varying degrees of potency and usage. Here's a brief overview: Schedule I - Cannabis and its Resin (Charas): Classified as extremely potent with no accepted medicinal use, Charas is strictly prohibited, and penalties for its possession or use are severe. Schedule II - Ganja: Ganja, the flowering or fruiting tops of the Cannabis plant, is less potent than Charas but still harmful. Strict controls are imposed on its production, sale, possession, and use. Schedule IV - Cannabis Plant and Cannabis Seeds: The entire Cannabis plant and its seeds are listed under Schedule IV, regardless of potency. While considered less harmful, restrictions still apply to its cultivation, sale, and possession. As responsible members of society, it is crucial for us to be aware of these regulations and the potential risks associated with Cannabis abuse. By educating ourselves and those around us, we can contribute to a safer and healthier community. #NDPSActAwareness #CommunityAwareness #SaferSociety #HealthyLiving #bhang #hemp

Interesting to see some of the research that is informing the way that Minnesota rolls out its adult use program.... A recent demand study done by the state illustrated that the state would need a minimum of 381 dispensaries to satisfy the current demand for cannabis products. That's a stark change from the current numbers (>25 dispensaries) and for many that brings about a welcome change to the current duopoly. Also of note is this finding: "Of those who reported obtaining any amount (>0 grams) of cannabis within the past month, the most frequently reported sources individuals obtained cannabis were from friends and family (67.6%)and an adult-use dispensary (61.3%) (what is assumed to being viewed as lower-potency hemp edible retailers by respondents)." Hemp derived product retailers are filling the gap where adult use dispensaries are not available and consumers can't easily tell the difference. I wouldn't be surprised if medical dispensaries in the state run a "full court press" on marketing and outreach initiatives that are meant to capture loyalty in response to some of these findings. Sometimes building a moat is the best strategy. https://lnkd.in/gyExYz76 #MinnesotaCannabis #MedicalCannabis #DataInformedDecisions
