In litigation, verdict value focuses on winning big in court, while settlement value emphasizes compromise and peace. Understanding these differences is crucial in mediation. Litigation is adversarial—clients and lawyers prepare for a courtroom battle, aiming for a huge verdict. Mediation, however, seeks middle ground and practical resolutions. It's about finding a "bird in the hand" rather than risking it all for a potential win. In short, yes, mediation is confidential. This means that details from discussions during the mediation process cannot be used in any other processes such as court. Mediation should be a safe space where clients can have an honest discussion without feeling it will be used against them later. I know from years of experience that most clients will speak to someone about what happens in mediation. Mediators, how do you feel about that as a practitioner and how do you deal with it in your sessions? Let me know your thoughts in the comments section. #FamilyMediation #FamilyLaw #MediationProcess #FamilyLawyers

🤝 Mediation Over Litigation: A Gentle Approach ✨ Before considering court action, seeking avenues like negotiation, family mediation, and obtaining legal advice can lead to more harmonious outcomes. Mediation, in particular, is often encouraged as it provides a neutral platform for parties to communicate. If direct contact is denied, indirect methods like letters or technology can serve as bridges. MML Law promotes peaceful resolutions whenever possible. When it's not, we are always on your side. #FamilyMediation #PeacefulSolutions #MMLMediation

Stuck in a legal mess? Fear not! Mediation is here to offer a cup of tea and a chance to talk things through, transforming the way we resolve disputes in the UK. Forget drawn-out battles and high costs. Mediation is: 1. Faster: Sort things out 2-5 times quicker than litigation, saving you valuable time and stress. 2. Cheaper: Ditch the legal fees and courtroom drama. Mediation costs significantly less, leaving you more dosh for other things. 3. Friendlier: Unlike the adversarial nature of court, mediation fosters mutual understanding and respect 4. Win-Win: It's not about who's "right" or "wrong". You work together to find solutions that benefit everyone involved. So ditch the courtroom drama and embrace the power of mediation. It's time to talk things through, find common ground, and move forward – together. #mediation #effectivesolution #disputeresolution #fastersolutions #winwin
