The #Texas Data Privacy and Security Act (#TDPSA) takes effect today, July 1, 2024. This law aims to enhance the protection of personal data for Texas residents by affording consumers new rights and placing affirmative obligations on all covered organizations. In advance of today’s effective date, Texas’s Attorney General (AG) recently unveiled “a major data privacy and security initiative,” which included the creation of a team focused on “aggressive enforcement” of Texas’s #privacy laws, including the TDPSA. The TDPSA, coupled with the AG’s public statements detailing enforcement intentions, reinforces the need for all covered organizations to proactively develop a compliant and tailored #PrivacyProgram. New Jersey is set to become the first state to pass a privacy law in 2024—with Senate Bill 332 (SB 332). Unlike many other privacy laws in force today, SB 332 doesn’t have a revenue threshold. Rather, the law applies to companies that: 👉Do business in New Jersey (NJ) or target their products/services to NJ residents AND 👉Process or control personal data of 100,000+ New Jersey consumers OR 👉Process or control personal data of 25,000+ New Jersey consumers AND receive revenue or discounts from the sale of personal data 👉Law requires that businesses obtain opt-in consent before collecting and processing sensitive data. 👉 SB 332 compels businesses to honor universal opt-out signals within 18 months of the law going into force. 👉The right to request access, delete, and correct their personal information. 👉The right to transfer their data in an easily transmissible format. 👉The right to opt-out of the sale of personal data for targeted advertising, automated decision making, and profiling. 👉Right to appeal 👉Conduct data protection assessments 👉SB 332 grants exclusive authority to enforce its provisions to the Attorney General. Potential penalties include penalties of up to $10,000 for the first violation and up to $20,000 for the second and subsequent violations. 🚨 The California Privacy Protection Agency (CPPA) just released their 2024 "Annual Enforcements Updates and Priorities." Notably, the report includes statistics on the complaints received over the past year and highlights the most and least common complaints.
