New Jersey is set to become the first state to pass a privacy law in 2024—with Senate Bill 332 (SB 332). Unlike many other privacy laws in force today, SB 332 doesn’t have a revenue threshold. Rather, the law applies to companies that: 👉Do business in New Jersey (NJ) or target their products/services to NJ residents AND 👉Process or control personal data of 100,000+ New Jersey consumers OR 👉Process or control personal data of 25,000+ New Jersey consumers AND receive revenue or discounts from the sale of personal data 👉Law requires that businesses obtain opt-in consent before collecting and processing sensitive data. 👉 SB 332 compels businesses to honor universal opt-out signals within 18 months of the law going into force. 👉The right to request access, delete, and correct their personal information. 👉The right to transfer their data in an easily transmissible format. 👉The right to opt-out of the sale of personal data for targeted advertising, automated decision making, and profiling. 👉Right to appeal 👉Conduct data protection assessments 👉SB 332 grants exclusive authority to enforce its provisions to the Attorney General. Potential penalties include penalties of up to $10,000 for the first violation and up to $20,000 for the second and subsequent violations. The Texas Data Privacy & Security Act is in effect as of today, and the Texas AG's Office has made clear their intention to aggressively enforce this and other privacy laws (and have already started doing so). Notably, the team responsible for enforcing the TDPSA comprises 10+ attorneys, far exceeding the size of similar teams in most other states. 🚨 The California Privacy Protection Agency (CPPA) just released their 2024 "Annual Enforcements Updates and Priorities." Notably, the report includes statistics on the complaints received over the past year and highlights the most and least common complaints.
