Clients regularly spend more than they should to litigate small cases, and often it's partly the lawyer's fault. You can help fix this though... Save yourself headache and save your clients money by explaining to them how helpful it is to get things in a well-organized manner. Most clients don't give much thought to this up front, and so sometimes you may just end up with a plastic shopping bag of muddled documents on your desk. Well, to make heads or tails of that bag someone has to go through it. Whether it's the client going through it at home and organizing it, or a junior doing it at $200+/h, or yourself at a higher rate still - someone WILL have do it. I've had some clients spend more on smaller files - eating into their own recovery - to have me organize their documents than some on bigger files. Some people are willing to spend. But, honestly, most people just don't give it much thought, and most people are appreciative of the information. After all, it's easier for them since they actually lived the facts. So, again, give your clients a better experience by asking them to organize things for you. Even if they choose not to, at least they will have had the option and given it some thought. And trust me, the vast majority of people would rather keep $2,000+ in their pocket instead of paying someone to literally shuffle papers around - even if it does add value. This post is inspired by Tali Green's post today about getting a mish mash of relevant evidence. It's very worth noting too that these days companies like goodfact can really help make the process a lot easier and less painful for everyone involved. Even if you get a well organized bundle - it's hard to beat a great chronology.

Change In Ability To Recover Costs From The Losing Party. From October 1st 2023 a fixed costs regime will be implemented for the majority of claims for damages up to £100,000. This means that, whereas under the current costs rules, the winning side is usually able to recover a substantial amount of their reasonably incurred costs, after the change they will only be able to recover costs up to a fixed amount, no matter what the total costs incurred are. This is likely to result in the winning party having to pay a higher percentage of their own legal costs, whether bringing or defending a claim. |Find out more via the link.
