How do you quickly get paid for any and every restoration job? There's a few critical pieces. 1. I have a couple questions for my reputable public adjuster and restoration contractor friends…. I have received documents indicating a very close relationship between a national public adjusting firm and a national restoration contractor. The documents indicate quite clearly that the restoration contractor has a practice of handing all of its building owner customers a contract with the public adjusting firm and obtaining a signature on the contract. I have also received documents showing the restoration contractor’s internal job cost worksheet, which reflects the amount billed to the insurance company. It includes the following line as one of the cost items: PA FEE .10 $____ Before I package this all up and send it to the Texas and Louisiana Departments of Insurance, I have two questions: 1. Is there ever a scenario where it would be proper for a restoration contractor to hand a public adjuster agreement to a building owner for signature? 2. Explain to me why it isn’t insurance fraud for a restoration contractor to submit an invoice to an insurance company knowing that it is paying 10% of the stated invoice amount to the public adjuster rather than using the entire invoice amount to complete repairs as represented? Bonus Question 2a. If the claim is in Louisiana, where public adjusters cant charge a contingency fee, isn’t this arrangement improper for that reason as well? I sincerely do want to know if there is any argument this conduct is proper before I submit my report.
