2006 was a long time ago. Proof? This social admin was pleading with his dad to buy the new Red Hot Chili Peppers album "Stadium Arcadium" on iTunes. After all, my bus ride to school would be ruined if I didn't have my favorite songs on my iPod... and while I've done some growing up, some of Michigan's most important environmental law has been frozen in time. On Friday afternoon the Georgia EPD granted permits to Twin Pines to strip-mine three miles from Okefenokee Swamp. This will be a "demonstration mine" of 600 acres digging out titanium dioxide, staurolite, and zircon. * I am sick that I live in a state and country where this happens. I'm sick that we've spread capitalism across the entire freakin planet. I'm sick of Georgia EPD thinking that white paint is more important than the atmosphere. This is not about Okefenokee Swamp. This is about a mindset of LAWS that favor destruction & demolition of nature & the bottlenecking of life on earth. That includes human life. With each decision like this, life on earth gets squeezed. Your life gets squeezed. * And it's about the corporations pushing laws that destroy. * I've been fighting every day of my life to protect nature, and the destruction just gets worse and worse and worse. * Look everywhere around you. Take a good look around. I'll just single out my home state of Georgia for a minute and say, Look what we've done to the interstate medians. To roadsides. To small farms. To pollinators. To bees. To forests. To natural pine forests. To Bryan County for those ridiculous enormous, life-sucking manufacturing plants. To the right whales. To the air quality of Atlanta. To trees everywhere. Now to Okefenokee. * I'll end with a message to Georgia EPD from Bill Sapp of Southern Environmental Law Center. Surely you folks at EPD have hearts and souls and minds of your own. Maybe you're scared that the law is not on your side for denying these permits. Bill says otherwise. "EPD has the authority to deny these permits because the company cannot prove the Okefenokee and St. Marys River won’t be harmed in the process." * Then again, what does it matter what the law says? We reach points in human history where SOME THINGS ARE ABOVE THE LAW. What's above the law? you may ask. * Life on this planet is above the law. * You folks in leadership who can't help us save ourselves, PLEASE STEP DOWN.

‘Since it is argued that corporations and states have much power in defining environmental harm, establishing environmental laws, and policing them in ways which may not sufficiently protect the environment, radical green criminologists such as Lynch and Stretsky have argued for a ‘transgressive approach’ in which activities that harm the environment but do not break the law should nevertheless be recognised as green crimes. A good example of legalised risk to the environment would be the granting of licences to use the technique of high pressure ‘fracking’ to release oil and natural gas deposits deep underground, a process accompanied by the danger of earth tremors and water pollution. Taking this radical green position into the area of pressure group activity, it can be argued that breaking the law to protect the environment from damaging actions which may not have broken the law may be justified.’ Sociology An Introduction and Beyond, p.671. There is a saying "No man ever steps in the same river twice, for it’s not the same river and he’s not the same man.” by Heraclitus I have been researching the Public Trust Doctrine for a water matter and I am pleased to see 2 (two) new journal articles one by Saunders and another by Ngcobo on a reported matter that I argued in the High Court and the SCA on stormwater management, namely Featherbrooke. These articles are also on the back of an article by esteemed environmental researcher, A Van der Berg on the same case. This case has been premised on another reported decision that I successfully argued in the High Court, namely Propshaft, on municipal responsibility to manage stormwater. Our communities face climate change, ageing cities and ever increasing demands on natural resources as against chronic lack of service delivery. I hope that jurisprudential advances in this area of environmental law, will assist communities and our river systems. #environmentallaw #biodiversitylaw #waterlaw
