🔥 Important Update on AI-Generated Robocalls: A Stand for Integrity and Safety In a significant move to safeguard integrity and public safety, the Federal Communications Commission (FCC) has taken a bold step by making AI-generated robocalls illegal. #1 This decision comes in the wake of a deceptive incident where a robocall, mimicking President Biden's voice, aimed to influence voter behavior in New Hampshire's primary election. #2 The FCC's ruling is a clear statement against the misuse of advanced AI technologies, including voice-cloning and image generators, which have found applications in elections both domestically and internationally. #3 The exploitation of these tools to conduct scams, spread misinformation, and impersonate public figures in unsolicited calls poses a serious threat to the public. It's crucial to recognize the dual-edged nature of AI advancements. While AI offers remarkable benefits, its potential for misuse requires us to stay vigilant and make informed decisions. Last week, President Biden issued a historic executive order on safe, secure and trustworthy artificial intelligence to ensure that America "seiz[es] the promise and manag[es] the risks of artificial intelligence." But, contrary to some of the public discourse, the AI landscape is not the Wild West. Such discourse downplays existing federal and state laws, including laws prohibiting fraud, defamation, and even discrimination. In my Oped published today in Law360, I set forth key steps companies should take to protect their companies from these legal and business risks (this includes companies considering using an AI product, not only designing or developing AI systems). To summarize: 1) Evaluate the AI system/product for legal risks before use or deployment; 2) Include an evaluation for potential bias or discrimination in those pre-deployment reviews; and 3) Continue regular reviews after the AI is deployed. AI is a rapidly developing technology and will require ongoing vigilance. If companies take these steps, they can be more confident that they are using, or developing and launching, AI products that will benefit their customers, while eliminating or reducing legal risks.
