The rough episode title usually comes to me right after I finish recording an interview for Clause 8 Podcast. However, I had trouble settling on one for this episode because there are so many interesting facets to Erich's story and the priceless advice he shared. He was famously profiled as a patent troll villain in the NYT but is widely admired as a visionary trailblazer in the patent world even by ardent opponents of strong patent rights. One of the most fascinating parts of his story is how he went from running a company and successfully fending off a patent lawsuit for only $500 K by ignoring his litigation lawyers' advice to becoming one of the world's most successful patent monetizers himself. He generously credits his success to being "trained by the best in the business": Ron Katz (the innovator who filed that patent lawsuit), Bob Steinberg of GenerativeIQ (formerly of Latham), and Sean Pak of Quinn Emanuel. https://lnkd.in/eceGnX_X

Does it seem like you've been getting more Section 101 rejections recently? That's because the USPTO's rate of making 101 rejections in OAs is reaching an all time high this year and is on the cusp of overtaking the pre-2019 PEG (2019 Revised Patent Subject Matter Eligibility Guidance) level of rejections. The most dramatic increase in §101 rejections seems to be in USPTO’s working group 2120, which examines patent applications related to AI. Much more here:
