The U.S. Patent and Trademark Office (USPTO) has announced the extension of the First-Time Filer Expedited Examination Pilot Program. This program enables eligible first-time filers to have their patent applications expedited out-of-turn and receive prompt initial written feedback from patent examiners, referred to as the "first office action." The primary objective of this program is to provide emerging innovators with expedited feedback, facilitating the acceleration of their product-to-market timeline. The extended pilot program is effective from March 11, 2024, until either March 11, 2025, or the point at which the USPTO grants a total of 1,000 petitions under the program, whichever comes first. Where is it important to file for patent protection today? When I started my career in patent law, you could decide to only patent in the United States. Patents outside of the U.S. were nice, but not necessarily required for global monetization (with some exceptions of course). That's no longer the case. Now, whenever I speak with people on the business side of IP, I ask them: What is the value of the U.S. side of a portfolio versus the rest? The USPTO has issued a notice of proposed rulemaking that could significantly alter the landscape of patent practice with respect to terminal disclaimers. Here’s a deeper look into what’s changing and how it might affect you: 1) If a patent connected by a terminal disclaimer is invalidated due to prior art, all associated patents could also lose enforceability. This is a big shift from evaluating patents individually to looking at them as a group. 2) This rule could discourage filing patents for minor tweaks of inventions, pushing innovators to focus on more significant and distinct innovations to avoid possible enforceability issues. 3) The USPTO aims to encourage competition and cut down the high costs tied to challenging several similar patents. By connecting the enforceability of related patents, fighting these patents in court could become simpler and cheaper. 4) Patent applicants might need to rethink their approaches, considering more comprehensive initial claims or preparing for more robust defenses against double patenting rejections. PTA can extend the standard 20-year term, making it crucial to determine the actual patent expiration date. Terminal Disclaimer: Often filed to overcome a non-statutory double patenting rejection, a terminal disclaimer can shorten a patent's term to align with an earlier-expiring cited patent.
