NYS is aggressive, and Suffolk County is one of the most aggressive in New York. Many people don't realize there could be serious consequences to not paying sales tax: the potentially huge amounts owed personally, ridiculously high interest rate and penalties, not to mention possible jail time. The sales tax agencies are usually more aggressive than the income tax agencies. A Board of Equalization (BOE) sales tax audit in California is serious business.

CA and NY are the toughest overall to deal with in my experience. But sales tax and payroll taxes are considered to be trust funds - meaning the business is holding someone else's money and forwarding it to the government. That's why it's tougher to get through a sales tax or payroll tax issue than an income tax issue.

Inevitably, paying employees off the books goes hand-in-hand with sales tax fraud. Body shops are on the Dept of Labor's "hit list" for that reason on both the state and federal levels. The feds are much more amenable to settlement and corrective action whereas the state auditors are all about the money.
