Recent rulings by Abu Dhabi courts have strengthened the UAE's arbitration framework by allowing the transfer of arbitration agreements to the Dubai International Arbitration Centre (DIAC), even when original contracts specified other now-defunct venues. Very grateful to Arabian Gulf Business Insight for the opportunity to provide my thoughts and insights on the arbitration and construction landscape in the UAE and Middle East. There is and will be international debate as to the aftermath of Decree 34 of 2021 and arbitration agreements containing DIFC-LCIA clauses, particularly as to enforcement within jurisdictions outside the UAE. However, the UAE's attitude and approach, evidenced with the Abu Dhabi jurisprudence, should comfort parties seeking to enforce arbitration awards within the UAE, as these awards are deemed enforceable despite the abolition of the DIFC-LCIA centre. #arbitration #AGBI #construction #disputes

The UAE's involvement in high-profile international arbitration cases has fuelled the interest in the enforcement of arbitration awards. The steps involved in enforcing an arbitration award may vary but the general process is as follows: 1️⃣ The party seeking to enforce the award must first obtain a copy of the award and make sure that it is valid and enforceable. 2️⃣ The party seeking to enforce the award must then register the award with the Dubai International Arbitration Centre (DIAC). 3️⃣ Once the award has been registered, the party seeking to enforce the award can then apply to the UAE courts to have the award enforced. This is a complex process and several factors can affect the enforcement of an award, such as the jurisdiction of the arbitral tribunal and the nationality of the parties.
