  Recent judicial clashes in high-profile litigation involving the Emoluments Clauses, Appropriations Clause, and Congress’s subpoena power have highlighted that the doctrine governing whether structural constitutional provisions grant legal rights that can support nonstatutory review has become surprisingly unclear. In his article, Richard Murphy argues courts should use the same “zone-of-interests” test that they have developed to determine whether a plaintiff can invoke the Administrative Procedure Act’s statutory cause of action to determine whether a plaintiff can invoke a nonstatutory cause of action for injunctive relief to enforce a constitutional provision.   Read more here: https://lnkd.in/gWwdEefw

The Supreme Court has upheld the Supreme Court (Practice and Procedure) Act 2023, which limits the chief justice's powers. The decision comes after a series of hearings. However, five members of the full court bench opposed the law. In a majority decision of 8-7, a section of the act allowing retrospective appeals has been declared unconstitutional. This law, enacted in April, empowers a three-member committee to take suo motu notice and aims for transparent court proceedings. It also governs how benches are formed and outlines the right to appeal. Federal Decree Law No. 29 of 2023 was introduced on September 25, 2023, amending certain provisions of Federal Law No. 13 of 2016 regarding Judicial Fees of Federal Courts. The effective date of this decree will be sixty days from its publication. The new decree introduces changes to the calculation of judicial fees in federal courts by introducing separate fees for interlocutory applications and applications from litigants seeking to intervene in proceedings.
