Yet another update to the Sponsor Guidance was published this week - fairly limited changes this time around. In particular, the changes confirm the abolition of the licence renewal process (which we already knew about) and confirmation that sponsors no longer have to make reports where a sponsored migrant has a hybrid working arrangement so long as they continue to regularly visit their "traditional" work location (i.e. the branch/site named on the licence). We understood this was the approach being adopted by UKVI in practice (primarily to avoid a deluge of reports!) but it has taken them several months to codify the position in the Guidance. Interestingly, there is still a requirement to report entirely remote work with little or no requirement to attend business premises or a client site ("a contractual home worker"). In this case, the Guidance explicitly states that the Home Office reserves the right to explain why they need to be sponsored to come to the UK at all - if (for example) they could work remotely from their home country. This is certainly something which the team and I have seen in practice and is worth spending time exploring so that you can set out a clear business rationale to the Home Office. There is no guidance on what might be acceptable reasons, but the sorts of reasons which we have put forward have included practical ones such as time differences, data security, being able to attend occasional in person team meetings, or visiting key clients/suppliers in person. Of course, if you're not able to put forward a cogent reason there is a significant risk of challenge by the Home Office. #skilledworkers #immigrationlaw #sponsorlicence

Remote workers may want to think twice about trying to return to more restrictive on-site work, regardless of pay or visa sponsorship.
