The USCIS Final Fee Rule is expected in the coming weeks. USCIS has emphasized the need for a significant fee increase to better cover operating costs and manage its workload more effectively. Historically, once the rule is published in the Federal Register, it is likely to take effect at least 60 days later. Providing some context, on January 4, 2023, USCIS released a proposed rule on adjusting the fee schedule, proposing a 40% overall weighted average increase in application fees. USCIS is a fee-funded agency so if the government shuts down, it is generally operating. The exception to this is programs that receive appropriated funds – E-Verify, the EB-5 Immigrant Investor Regional Center Program, Conrad 30 J-1 doctors, and non-minister religious workers, which are suspended or otherwise impacted. The Dept. of Labor's OFLC's FLAG and PERM, would be inaccessible, and BALCA dockets will be placed on hold. Visa and passport operations are fee-funded and thus are not normally impacted by a freezing of funds. However, consulates can be impacted if there are insufficient fees to support operations. 🚨 On Jan. 30, 2024, USCIS published a final rule to adjust certain immigration and naturalization benefit request fees for the first time since 2016. This final rule and new fees go into effect on April 1, 2024. 🗓️ Unlike many other federal agencies, USCIS is almost entirely fee-funded. Approximately 96% of its funding is from filing fees, and only about 4% is from congressional appropriations. Employment-based cases will shoulder the biggest increases under this rule. Fee increases mirror most of those in the proposed draft last year, although some added exemptions and discounts for certain applicants are also noted. DHS published a final rule that allows USCIS to increase filing fees for a number of visa categories beginning on 04/01/2024. Among the increases: ✅ H-1Bs: Filing fee increasing from $460 to $780 + Asylum program fee added for $600 (if you have 26 or more employees). ✅ I-140: Filing fee increasing from $700 to $715 + Asylum program fee added for $600 (if you have 26 or more employees). ✅ H-4 Dependent fees increasing from $370 to $470. ✅ EAD fees increasing from $410 to $520. ✅ I -131 fees increasing from $575 to $630. ✅ AOS with work and travel authorization is increasing from $1225 to $2330. These are substantial fee increases and is in addition to the increase of the premium processing filing fee on 02/26/2024. The H-1B registration fee for registrants in the FY2025 H-1B lottery will remain $10 but will go up to $215 next year. #immigration #uscis #uscisfilingfees #immigrationlawyer

USCIS will be implementing new filing fees for on April 1, 2024. The USCIS is certainly entitled to raise fees over time and should do so since the agency has not raised fees since 2016. I am skeptical that higher fees will solve USCIS backlogs. However, if additional funds do allow the agency to address systemic problems and drive down processing times, these costs will improve service and experience for foreign nationals and US employers. However, the new employer tax on I-129 and I-140 petitions to fund the review of asylum petitions feels egregious and unfortunate. US #employers seeking #talented individuals to work for them should not be further taxed to pay for the creaking #asylum system. This is an obligation #congress should fulfill.

Today, April 1st, the USCIS fee increases take effect. In addition to the increased costs, there are a number of changes to filing procedures including new versions of forms, new filing locations, changes to premium processing time frames, and no grace period. USCIS has issued a fact sheet on processing times for a range of forms. It shows that median processing times are substantially lower in fiscal year 2024 than in the previous one. In particular, processing times for the employment authorization documents for green card cases are down to 3.6 months from 2017.
