This post by my fellow Headshots Matter member Chris Henry led to some really interesting comments on the value of LinkedIn and how best to use it. I have always found networking really tricky. I don’t like social media and I’m only on it because I need to promote my offering and to generate sales/bookings (I get that it’s different for others and they actually enjoy social media). So how do you balance the need to ‘sell’ with genuine connection and engagement? No matter what I post it always feels a bit disingenuous because I know I’m only here because I want eyes on my business….. I’d love to know how others manage to reconcile this with themselves. I’d really love tips on how to best make genuine connections - how to network effectively without it feeing false or like this game where we are all supposed to pretend that we’re not really here to ‘sell’?

A fundamental or human right is not subject to contract. Where parties do not expressly consent to waive a fundamental or human right, a waiver cannot be implied in the circumstance. In fact, it is trite law that a person cannot contract away their fundamental rights. It behoves on a photographer to expressly request permission to publicly display a client's pictures or exploit them in any way, manner, or form, especially where the photographer was commissioned for the purpose of capturing the photograph. Where a client hasn't expressly provided the requisite consent, a photographer cannot claim an implied waiver, neither can they claim a supervening right over a fundamental or human right. Upon this premise, we can appreciate the absurdity created by an unchecked application of intellectual property rights within a photographer's context. The test is to determine whether or not the photographer can unrestrictedly or uninhibitedly exploit the right which is claimed to be possessed in the material, and whether or not the photographer was contracted for the sole purpose of creating the intellectual property.
