Is Third Time the charm for J&J? Under J&J's new plan J&J would pay $6.5 Billion to resolve all ovarian cancer cases - approximately 54,000 - via a third bankruptcy filing. As part of the deal J&J said it will set aside a total of $11 billion total to resolve additional claims over the next 25 years. J&J claims 99% of the claims filed against it related to ovarian cancer and that it has resolved 95% of all meso cases. Any remaining meso cases would be resolved outside of the bankruptcy. Under J&J's plan, there would be a July 26th deadline for claimants to vote at which time J&J believes it would have over 75% of claimant supporting the resolution. J&J likely would not have announced this proposal unless it felt confident it had the support of 75% of the claimants. Will J&J be able to reach this threshold to present a pre-packaged bankruptcy to the court? Or will Plaintiffs hold out in hopes of securing a higher award? #joedoeslaw #masstorts #talc

Johnson & Johnson begins settling Talc Cases. Yesterday, J&J announced it has settled 100 Talc cases involving Plaintiffs with mesothelioma, a rare type of cancer that is linked to asbestos. J&J supposedly entered into an inventory settlement with 3 undisclosed law firms. By settling these cases J&J cases only faces one more mesothelioma case that is scheduled for trial later this year. Expect that case to settle as well, whether it be before trial or during trial, there is absolutely no way that case goes to verdict. J&J then will have a clear docket for the next few months. What does J&J's announcement tell us? J&J is concerned about the meso cases but views them differently from the ovarian cancer cases. I believe J&J will now proceed to resolve inventories of all mesothelioma cases. J&J will then use that value of the settlement of the mesothelioma cases as the ceiling for the ovarian cancer cases. J&J will likely start settling inventories of ovarian cancer cases, with a focus on the ovarian trial cases of those firms that supported the last bankruptcy. Is now the time to get new Talc cases? What is the status of the Zantac Mass Tort? Momentum is slowly building and there is some optimism that things will turn in favor of those injured by this product voluntarily pulled from the market. Although the MDL judge excluded Plaintiffs' expert and dismissed all of the cases, litigation is still active in various state courts. In CA state court, there was a settlement of the first trial case involving bladder cancer. The second CA state court trial is scheduled for November and will involve a Plaintiff who was diagnosed with breast cancer. We are waiting the ruling on the admissibility of Plaintiff's expert which should come in the next few months. In Illinois, Nevada, and Florida state court, cases are moving towards to trial. The majority of cases remain in DE state court with over 70,000 cases pending. The court recently entered orders related to the bellwether process with an initial batch of 300 cases selected. After service of Plaintiff Fact sheets, the bellwether cases will be cut in half and depositions conducted over the next few months. Simultaneously, the parties are deep in motion practice with expert admissibility arguments likely to be conducted in January 2024. Very interesting read from Fierce on a new Guardant x Illumina commercial partnership. As part of the agreement, Illumina has agreed to settle an intellectual property litigation against Guardant, which they initially filed last year in the midst of their failing acquisition attempt of GRAIL. The litigation claimed that Guardant co-founders took proprietary information from Illumina, which was used in the development of their cancer blood test. According to the article, many of Illumina's claims had already been dismissed by a judge back in January, and the two companies have agreed on a three-year deal as part of a settlement to drop the remaining patents in question. The deal includes a research agreement and Guardant purchasing DNA sequencing supplies from Illumina. The settlement comes amidst Illumina's quarterly earnings call yesterday, where they announced continued executive leadership movement, and an anticipated 1% revenue growth in 2023 despite their NovaSeq X rollout. Seems like the 'bad blood' between these two testing giants is in the past as Illumina continues to navigate the post-GRAIL fallout...
