Yesterday I recorded a "Kassi &" podcast episode with Will Kreth about the work he is doing with HAND (Human & Digital): talent identity provenance for real & virtual identities in entertainment, sports, and more. Later that night I read an article about ElevenLabs securing the rights to use the voices of Sir Laurence Olivier, Judy Garland, James Dean, and Burt Reynolds to train and create AI clones for use in its platform - which is perfectly in line with the conversation Will and I had! Generative AI, including the creation of voice clones and deepfakes, creates some interesting legal issues - and opportunities! The important thing is to learn about them and become prepared. Trust and estate attorneys have a potential new set of assets to address with their clients. Kassi Burns and Will Kreth — if the platforms pay to license the NIL it’s should be ok as long as the deceased owner would have intended for the estate to the posthumous use—-many of the now dead could not even imagined such tech developments so it’s pretty much all about heirs’ substitute wishes…going forward celebs (and anyone else) could use “Do not or Do Bot/ Gen AI” clauses in their wills/trusts to make their preferences known :) Important conversation!!!!

This is actually wonderful news for creatives, Kassi - and a win-win for both themselves and the tech-companies. Reaching agreements is going to solve a lot of IP-related issues that GenAI brings to the table.

Thanks, Kassi! ElevenLabs posted an update on their company page about the Iconic Voices product, and from the comments - you'd think they'd dug up the graves of these stars under the cover of darkness to steal their bones. To those folks, I say: family estates have been licensing NIL rights of celebrities for many, many years - WSJ even did an article on it, that dead celebrities are called "Delebrities" in the business. If Liza Minnelli is happy with the results (as she apparently is from the quotes) it's her call. Sara Adami-Johnson rightly says on this post of Kassi's that living public figures and their lawyers may want to put "Do Not Train" or "No AI" clauses in their wills to direct the estates in the future. James-Earl Jones made a conscious decision to license his voice likeness to Lucasfilm / Disney so that new works of Darth Vader will always have his voice.
