This SEC enforcement action is getting headlines because it's the first action under the new Marketing Rule, but the issues are more like a Greatest Hits album of the staff's long-standing concerns: crypto, a retail investor base, custody, hedge clauses and hypothetical performance. The enforcement staff might only be opening the door because there's a new rule to enforce, but once it's open, they won't just look at the Marketing Rule. They'll look at other disclosure, compliance with policies and procedures, and (although it wasn't an issue here) they're continue to look at recordkeeping issues.
