Thanks for the shout out, Jason Malumed. The Pa. Supreme Court nailed it. 5-0. It's time for the PLCB to simply do the right thing and return the money they unlawfully took.

For over five years, the PLCB illegally collected tens of millions of dollars in handling fees on Special Order wine and spirits. Despite knowing what they were doing was wrong and being told to stop by the legislature, the Governor, and the Courts, the PLCB willfully continued to plunder from its own citizens, believing they would never have to pay that money back because they were protected by sovereign immunity, an "archaic, unsportsmanlike, reason-defying, bizarre, self-stultifying, monumentally unjust, cruel, brutal, undemocratic piece of pedantical nonsense," that initially dates to a maxim from medieval England that said that, "the King can do no wrong." Today, with this opinion, the Pennsylvania Supreme Court has finally put a stop to this, emphatically showing that no one is above the law. When government agencies go rogue, the citizens of this Commonwealth shall be able to hold them accountable. I am grateful for the tenacity of John Papianou, Joseph Samuel, and the team from Montgomery McCracken Walker & Rhoads LLP, Zachary Morris of Bloomsday, and John Livingston of A6 Wine Co. for believing in our cause and making sure this important decision could arrive after years of hard work.
