CSAC Legislative Advocate Eric Lawyer joined the Washington Media Group 'A California Affair' podcast alongside representatives from the League of California Cities and California Special Districts Association to discuss two statewide ballot measures impacting local taxes, ACA 13 and the Taxpayer Protection and Government Accountability Act. These two ballot measures would have conflicting impacts on local government’s ability to implement taxes. The California Business Roundtable Taxpayer Protection and Government Accountability Act would raise the voter approval threshold for local taxes to two-thirds. This would restrict local government’s ability to raise taxes and fees, including retroactively. ACA 13 responds to the California Business Roundtable ballot measure by requiring future ballot measures that increase voter approval requirements to also pass by the same margin. SCOTUS Issues Another Ruling That Could Increase Challenges To Treasury And Other Federal Regulations: Yesterday, the Supreme Court held that the Administrative Procedure Act’s six-year statute of limitations begins to run when the injury is suffered, not when the challenged agency action becomes final. The decision in Corner Post, Inc. v. Board of Governors of the Federal Reserve System means, in part, that #taxpayers will be able to challenge #Treasury regulations, no matter how old, as part of their legal strategy during deficiency or refund proceedings. Along with the Court’s ruling last week in Loper Bright Enterprises v. Raimondo — which overruled the longstanding #Chevron doctrine that for 40 years largely deferred to federal agency regulations in interpreting ambiguities in the law — taxpayers may now have myriad opportunities to make #CornerPost and #LoperBright part of the legal strategy in many #tax controversies. #taxlaw #scotus #supremecourt #taxcontroversy #IRS https://lnkd.in/ewijTZqh

Taxpayers have the right to appeal an IRS decision in an independent forum. This is not just one of ten basic rights — known collectively as the Taxpayer Bill of Rights — it's the law. All taxpayers should know and understand their rights in the event they need to work with the IRS on a personal tax matter. The IRS's Independent Office of Appeals that handles a taxpayer's case must be separate from the IRS office that initially reviewed that case. Generally, Appeals will not discuss a case with the IRS to the extent that those communications appear to compromise the independence of Appeals: https://lnkd.in/eMWmx9AD
