Ok, this one is pretty cool. Solar tax credit transfer from a REIT over Evergrow’s platform. The credits originated from solar facilities tied to multi-family projects in California and DC. The IRA question was always whether there would be a market for these smaller tax credits. Check out Kelsey Misbrener's article. Money quote from Drew Torbin with Black Bear Energy Inc.: “With this transfer, we have proof of concept that demand exists for credits of this size and risk profile. Last week, the U.S. Supreme Court issued its decision in Loper Bright Enterprises v. Raimondo and Relentless Inc. v. Department of Commerce, overruling the Chevron doctrine. This holding overturns the decades-long practice of federal courts deferring to federal agencies’ interpretations of ambiguous statutes. The Court voted 6–3 to abandon this framework and recalibrate the balance of power between federal agencies and courts. #Litigation #SEC #Chevron
