Here’s how TikTok could avoid a national ban As Kesha prophesied years ago, TikTok [is] on the clock [to make sure] the party don’t stop. Yesterday, President Joe Biden signed into law the controversial new bill that gives TikTok’s Chinese parent company, ByteDance, 269 days (~9 months) to sell the social media platform or else have it banned in the US. TikTok replied: “Rest assured, we aren’t going anywhere,” CEO Shou Chew said in a video posted soon after the bill became law. TikTok is only considering a sale as a last resort if all the legal challenges it’s promising to fling at the US government don’t pan out, Bloomberg reported. That means this showdown is likely destined for months or years of court proceedings that could delay the ban from taking effect. TikTok and its users are expected to file lawsuits arguing that a forced sale infringes on the free speech rights of TikTok’s 170 million monthly US users. TikTok will likely also point to potential financial harm for creators who make a living off of the platform. The US is expected to argue that it isn’t violating the First Amendment, and/or that there’s no other way to protect national security and American users’ data from possibly being tapped by China (which China and ByteDance deny doing). If TikTok’s lawsuits fail…there might not be a US-approved buyer that has tens of billions of dollars and isn’t a massive tech company (because antitrust), but government and business leaders are trying to get a gang of investors together to go in on a Hamptons timeshare buy TikTok. Still, China has vowed to block any sale, and it considers the app’s precious algorithm to be a critical asset that ByteDance could retain no matter what.—Thank you to Morning Brew.

Annnnnnnd as expected, TikTok sues to block the forced sale to a non-Chinese entity or face a U.S. ban in January '25. It is getting spicy y'all! The suit alleges that the bill tramples on the free speech of Americans and singles this one platform out in the process, wherein other social media platforms are collecting similar amounts of user data, though without a Chinese parent. ByteDance, TikTok's parent, claims that it cannot and will not sell. But what would the ban actually look like? The Wall Street Journal draws this out in their video in the link below. The app stores would no longer be able to allow for users to download or update the app but they can't remove the app from user's phones. Also, Americans could choose to utilize a VPN to access the app as if they were in an alternative country. What would be the impact if TikTok does leave the U.S? TikTok ad sales in the U.S. are expected to grow 31% this year to $8.7B, according to forecasts from EMARKETER. What would be the impact be to creators and small businesses? It's not so easy as a creator to just pick up and move to another platform and build up an audience, especially as TikTok is one of the platforms in which creators can grow the fastest. The solution? Diversify your audience to as many platforms as possible while we all wait this out. On the small business front, some small businesses have made almost their entire business on TikTok so certainly shaky ground. Given the mixed success of previous similar legal challenges and the ongoing national debate over data privacy and security, the outcome of TikTok's lawsuit is uncertain. It will depend heavily on judicial interpretations of constitutional rights versus national security concerns and the specific details of the case as it unfolds in court. #tiktok

Whether China continues to own TikTok or if a consortium of US businesses own it, it still presents a problem, both in how data collected from users is used and how delivery of content is manipulated via its algorithms without explicit user approval. It is certainly dangerous if a highly opinionated owner is able to manipulate algorithms and steer the delivery of content to meet a particular agenda of any type, be it for business, religion, or politics. TikTok’s US ban explained 💡 You’ve probably heard word of the United States’ pending TikTok ban, but why is it happening and how did we get here? 🤔 US politicians first started to raise concerns about TikTok’s ownership and influence in late 2019, prompting the government to launch a review into ByteDance’s 2017 acquisition of Musical.ly in November 2019. The investigation was prompted by concerns surrounding data collection, as well as the app’s reported censorship of the Hong Kong protests. The Guardian also revealed internal documents that instructed TikTok moderators to censor videos that mentioned Tiananmen Square, Tibetan independence, and the religious group Falun Gong. As concerns mounted, president-at-the-time Donald Trump stated that he was considering banning TikTok as “one of many” ways to retaliate against the Chinese government in response to the coronavirus pandemic. Trump went on to order ByteDance to sell TikTok’s US operations in 2020, but the ban fell to the side as Trump lost the presidency and Biden entered office. New concerns around data handling were raised in 2022 when a Buzzfeed report revealed that the data of US TikTok users had repeatedly been accessed by ByteDance employees in China. Despite this discovery, ByteDance has continuously denied that the app shares user data with the Chinese government, stating that ByteDance “is not an agent of China or any other country”. This brings us to 2024. The US House of Representatives passed a bill demanding that TikTok sell the app’s US operations or risk being banned in the US, which was then signed by Biden. ➡️ What happens if TikTok gets banned? If ByteDance fails to sell TikTok or convince the Biden administration to ditch the ban, the app will be removed from the Android and iOS app stores and blocked on all web hosting services in the US. Americans may be able to bypass the ban and continue to access TikTok and its video content using VPNs. However, creators and viewers could also choose to migrate to other social platforms for convenience. ➡️ Will TikTok get banned in the UK? TickTok sues US government TikTok and its parent company, ByteDance, have filed a lawsuit in U.S. federal court against a law signed by President Joe Biden. The U.S. president had signed a law mandating the divestiture of TikTok or a potential ban on its use, affecting its 170 million American users. The lawsuit, filed in the U.S. Court of Appeals for the District of Columbia Circuit, argues that the law violates the U.S. Constitution's First Amendment free speech protections. Despite being signed by Biden on April 24, the law gives ByteDance until January 19 to sell TikTok. The companies claim divestiture is impractical and would silence millions of users.
