When #congress passed the Corporate Transparency Act in 2021, legislators took #bipartisan action to put an end to America's embarrassing reputation as a magnet for #moneylaundering. The reason for that reputation is that the U.S.---unique among leading nations---does NOT require corporations to disclose their owners. (What mischief could that possibly lead to?) On Friday, a federal judge in Alabama ruled that the law is unconstitutional, concluding that Congress lacked the power to enact it. For now, let's not debate the legal merits---though most observers reasonably expect the district court's order will not survive an appeal. Instead, consider the impact of striking down the #corporatetransparencyact, from the mouth of Ian Gary, head of the FACT Coalition, an anticorruption group: "This is a pro-crime, pro-drug cartel, pro-fentanyl ruling which undermines the rule of law and allows criminals to use anonymous shell companies to hide their dirty money from law enforcement." Well said. The stakes are high.
