Executive Director of Supervision David Eacott joined an expert panel at Mourant Trusts Forum to discuss how trustees are blending regulatory considerations into their fiduciary roles. David spoke about the importance of partnership between industry, regulator and government to establish a regulatory approach that balances stakeholder expectations and supports industry development in Jersey. David also highlighted the work we’re doing at the JFSC to improve our service delivery. We know from our industry survey that local engagement is a priority for our industry stakeholders. 🆕The Protected Trust Deeds (Miscellaneous Amendment) (Scotland) Regulations 2024 have been laid in the Scottish Parliament. If passed, will become effective 1 July 2024. - debtor to be habitually resident or have a place of business in Scotland - provisions for the AiB to revoke protected status of trust deed where 'material error or irregularity' which led to the protected status being granted - Dividend payment periods reduced. First dividend period now 12 months (prev. 24m) with 3 monthly (prev. 6m) thereafter - permission and agreement to be sought from AiB where trustee intends to refuse discharge to debtor - new provision for early discharge prior to normal 4 year period in 'extenuating circumstances' - new provision for AiB to be able to take over as trustee where existing trustee unable to do so and no other replacement can be found - annual supervision fee payable to AiB ⬆️20% to £120 per year, applied to existing as well as new PTDs 👉https://buff.ly/3wmXOMc

The Trustee (Perpetual Succession Act) Cap 164 has recently undergone amendments, with one of the significant changes being on the process of incorporation of Trusts.
